How we draw your will

  1. The first consultation, free

    You set out what your family actually looks like and what you want to happen to your estate. This is where we can also address anything the Intestate Succession Act’s default formula would not reflect about your family or your wishes.

  2. We draft it

    If you have children under eighteen, your Will can include a trust to hold and manage what they inherit for their benefit, rather than having their inheritance paid into the Guardian’s Fund until they reach eighteen.

  3. You sign it here

    You can sign at the same consultation. Witnesses are provided at our office, so you do not need to bring anyone with you.

  4. We hold the original

    We keep the original Wills in safe custody. A Will that cannot be found when it is needed creates exactly the problem it was intended to prevent—and a drawer at home is often where important documents disappear.

  5. We update it when life changes

    Marriage, divorce, the arrival of a new child, buying a property, or a death in the family can all change what you want your Will to say. We review and update existing Wills just as readily as we draft new ones, so your Will continues to reflect your wishes.

What happens if I die without a will?

Your estate is distributed on a fixed statutory formula, not according to your wishes. A partner you never married inherits nothing, and neither do stepchildren you did not legally adopt.

Can I stop my children's inheritance going into the Guardian's Fund?

Yes. A trust can be created inside your will so the inheritance is held and managed for your children instead. We draft these.

Can I sign it at the same appointment?

Yes, and witnesses are provided at our office, so you do not need to bring anyone with you.

Where should the original be kept?

We hold original wills in safe custody. A will nobody can find when it is needed causes exactly the problem it was drafted to prevent.

I already have a will. Does it need updating?

Possibly. Marriage, divorce, a new child, a new property or a death in the family can all mean an existing will no longer reflects what you would want.

Is a living will the same thing?

No. A living Will records your wishes about medical treatment if you cannot speak for yourself. We draft Living Wills too.

What happens to my will when I die?

The original is one of three documents needed to report the estate to the Master of the High Court, along with the death certificate and your identity document.
