How we handle an agreement

The first consultation is free. Most of the disputes that end up in court started as an agreement that was never written down, or one that was written down badly.
We draft it, or we read theirs
Agreements are drafted to reflect the particular arrangement, rather than being pulled off the shelf. If you have been handed something to sign—whether it is a franchise agreement, supplier contract, or lease—that you did not draft, it was prepared by the other side’s attorney to protect the other side’s interests.
We go through it with you
We set out what each party is entitled to and what each party is responsible for, so you know what you have committed to before you commit to it.
What happens if it goes wrong
What follows if the other side does not perform, and what remedies are available to you. Knowing that in advance is usually the most valuable part of the exercise, and it is the part most agreements handle badly.
If it is breached
Where the other party has breached the agreement and refuses to remedy the breach, the matter may need to proceed to litigation. We handle contractual disputes as well as drafting agreements, so if a dispute arises, you do not have to start again with a new firm.

Why put it in writing if we trust each other?
A written agreement is not about distrust; it is about certainty. It records what you both agreed and understood at the time—because, two years later, you may remember it very differently.
Can you check a contract somebody has asked me to sign?
Yes. We review agreements drafted by other parties, such as franchise agreements, supplier contracts and leases, and explain what you would be committing to.
What happens if the other party does not do what they agreed?
That depends on the terms of the agreement. A properly drafted contract sets out what happens if one party breaches it, including the remedies available to you. That is why it is worth getting the agreement right from the outset, rather than trying to fix things after they go wrong.
