How an estate is wound up
The first consultation
Bring the deceased’s Will, death certificate and Identity Document, and we will explain the process, and who the heirs are.
Reporting to the Master
We prepare the documentation and submit it so the estate can be formally reported and registered.
The appointment
Once the Master has reviewed everything, a Letter of Executorship is issued. This confirms the appointment and the authority to act. This is the document the banks have been waiting for.
Administering the estate
Closing or transferring banking accounts, settling the outstanding liabilities, and transferring the assets to the heirs.

Questions our clients ask us
Why are the bank accounts frozen?
Because until the Master issues the appointment, nobody has legal authority to deal with the deceased's assets. Reporting the estate is what gets that document issued.
What do we need to bring to the first meeting?
The original will, the death certificate and the identity document of the deceased.
How long does it take?
A straightforward estate is usually wound up in three to six months, depending on complexity. Property transfers, business interests or disagreement between heirs will lengthen that.
Can you act as executor?
Yes. We can act as executor, or as agent for a family member who has been appointed executor. Families often prefer the latter arrangement, as it allows the appointment to remain with the person chosen by the deceased, while the legal and administrative work is handled by an attorney.
What if there was no will?
The estate is still reported and administered in the same way. Who inherits is then decided by statute rather than by the deceased.
What happens to the house?
It is transferred into the names of the heirs, which is a conveyancing process. We attend to that ourselves.
