How mediation works, step by step
Making the appointment
The couple makes an appointment with the mediator. Mediation is voluntary. Neither of you can be forced into it, and both of you sign a Mediation Agreement before it starts.
The Mediation Agreement
This sets out the rules the process runs by, and how the costs of the mediation are shared between you. That is settled at the start rather than argued about later.
The mediation itself
The process usually begins at that first consultation. You work through the issues that need resolving and move towards an agreement you can both accept.
It goes to your attorneys
Once you have reached agreement, you each give it to your own attorney. The Settlement Agreement is attached to the divorce summons and served by the Sheriff of the Court.
It becomes an order of court
A court date is arranged. The court may then make the Settlement Agreement an order of court, at which point its terms are legally binding on both of you.

Do we both have to agree to mediate?
Yes. Mediation is voluntary and both of you sign a Mediation Agreement before it begins. Neither of you can be compelled into it.
Is what we agree actually binding?
Once the court makes your Settlement Agreement an order of court, its terms are legally binding on both of you and enforceable like any other court order.
Do we still need attorneys?
Yes. Once you have reached an agreement, each of you provides it to your own attorney, who will attend to the divorce summons and have the agreement made an order of the court.
Can you act for me in the divorce afterwards?
Only if both parties agree. If they do not, we refer you to attorneys who can act for you. A mediator has heard both sides in confidence and cannot take one side without the other's consent.
Do you only mediate divorces?
No. We also mediate parenting plan disputes and disagreements that arise after a divorce has been finalised.
Who pays for the mediation?
How the costs are shared is set out in the Mediation Agreement you both sign at the start, so it is settled before the process begins.
Is mediation cheaper than a contested divorce?
Usually, it is considerably cheaper and quicker because you are paying for a process focused on reaching agreement, rather than for two sides preparing to fight.
