How an antenuptial contract is done

  1. Book well before the wedding

    Come in early rather than in the week of your marriage. There is enough to do the month of the wedding, and both of the dates that follow are strict.

  2. You both sit down with Marlo

    We explain the matrimonial property systems available in South Africa, the difference between marrying IN and OUT of community of property, and what including or excluding the accrual actually means for the two of you.

  3. You choose your system

    Out of community of property with the accrual, or without it. The point is not to be steered toward one option, but for both of you to understand what you are signing before you sign the agreement.

  4. Signed before the wedding

    An antenuptial contract may only be prepared and attested by a Notary Public. Miss this date and you are married IN community of property, whatever the two of you intended.

  5. Registered within three months

    The signed contract must be registered in the Deeds Office within three months of signature. Miss that and it still binds the two of you, but a creditor of either spouse can simply disregard it.

When does the ANC have to be signed?

Before the wedding. It must then be registered in the Deeds Office within three months of the date it was signed.

What happens if we do not sign one?

You will be married IN community of property automatically, with a single joint estate covering both your assets and both your debts.

What is the accrual system, simply?

You each keep your own estate during the marriage but share the growth of both when it ends. The partner whose estate grew less can claim half the difference from the other party.

Which option is right for us?

That depends on what each of you owns, what each of you owes, and what you both want to happen if the marriage ends by divorce or death. Working through that is what the consultation is for.

We are already married. Is it too late?

No. A married couple can apply to the High Court to change their matrimonial property system. It is more involved than signing an ANC beforehand, but it can be done.

Do you do ANCs for customary marriages and civil unions?

Yes, as well as for civil marriages.

Do we both need to attend?

Yes. The decision affects both of you and both of you need to understand it.
