From signed offer to registered transfer

  1. Your agreement reaches us

    Once we receive the agreement of sale, we contact you, the other party and the estate agent, if applicable, to confirm our appointment and begin the registration process.

  2. Suspensive conditions are met

    Most agreements contain conditions that must be met before the sale becomes binding, with bond approval being the most common. Nothing can be lodged until these conditions are fulfilled, so the registration process waits on them.

  3. You come in once and sign

    We arrange a time for you to sign the transfer documents, with the buyer and seller signing separately. We collect your FICA documents at the same appointment. Once that is done, the rest is on us.

  4. We clear the way for lodgement

    The original title deed, bond cancellation figures from the seller bank, a Rates Clearance Certificate from the Municipality, a Transfer Duty Receipt from SARS where required, and the guarantees for payment. Each one involves a different institution working to its own timetable.

  5. Lodgement and registration

    Ownership changes hands on the day the transfer is registered in the Deeds Office, usually about six weeks after signature of the transfer documents. Where there is a home loan, registration is coordinated with the bond attorney so ownership passes at the same instant the bond is registered.

How long does a transfer take?

From the date you sign your transfer documents, registration typically takes about six weeks if nothing unforeseen happens. Once the documents are lodged in the Deeds Office, registration itself usually takes eight to ten working days.

What can hold a transfer up?

The six weeks assumes everything runs cleanly. Delays usually come from one of the moving parts: a suspensive condition not yet met, a bond approval still outstanding, a Rates Clearance Certificate held up at the Municipality, or a SARS transfer duty receipt still pending. You are welcome to phone and ask where your transaction is at any stage.

What happens on registration day?

Three things at once. Ownership transfers from the seller to the buyer, the purchase price is paid out according to the agreement, and the buyer becomes the registered owner. If you are selling, this is the day your money is released. If you are buying, this is the day the property is legally yours.

What if there are unpaid rates on the property?

A Rates Clearance Certificate cannot be issued while a municipal account is outstanding, and this is a common reason transfers stall. The firm recovered more than R1 million in outstanding rates and taxes on behalf of the Municipality, so this is familiar ground.

Do I have to come into the office?

Once. You sign your transfer documents and hand over your FICA documents at the same appointment.

Can you also register my bond?

No. Your bank appoints the bond attorney from its own panel. The two processes are coordinated to register together regardless.
